In response to the current real estate market, Western Australia has introduced lenient amendments to the Residential Design Codes, making changes to the requirements of ancillary dwellings, more commonly known as granny flats. The amended State Planning Policy 7.3 is now in effect, with changes to the code regarding ancillary dwellings.

Changes to Ancillary Dwelling Codes

1. Lot Sizes
Previously, a minimum lot size of 350sqm was necessary for an ancillary dwelling. In comparison, the new reforms have put an end to the minimum lot size requirement, including grouped dwellings and strata for all density codes.
Additionally, the requirement for an extra car bay has been taken out, except in densities where a car is likely vital due to inadequate public transport.
2. Planning Approval for Granny Flats
Planning approval for compliant granny flats of 70sqm and under is no longer a requirement. Compliant requirements include parameters for setbacks, site cover, height, visual privacy, and access. Deemed-to-comply requirements are outlined below.
A building permit from the local council will still be a requisite, with this process taking a maximum of 10 days.
3. Granny Flats: Deemed-to-Comply Requirements
- Maximum internal floor area of 70sqm
- Parking provided in compliance with clause 5.3.3 C3.1:
- No parking space is required if the location is within;
- 800m walkable catchment of a train station on a high-frequency rail route; or250m walkable catchment of a transit stop:
- On a high frequency transit route or that has multiple transit routes, with combined stop every 15 minutes during weekday peak periods (7am – 9am and 5pm-7pm)
- 800m walkable catchment of a train station on a high-frequency rail route; or250m walkable catchment of a transit stop:
- No parking space is required if the location is within;
- Ancillary Dwelling behind the street setback line
- Ancillary dwelling does not preclude the single or grouped dwelling from meeting the minimum open space and outdoor living area requirement
- Ancillary dwelling complies with all other R-Code provisions with the exception of clauses;
